By placing an order on our website www.terreandhorse.com, you are purchasing a product subject to the terms and conditions of sale available on this page. All orders are subject to product availability and are priced in euros:


Order processing times may vary according to availability and are subject to possible delays resulting from production delays, postal disruptions or force majeure for which Terre & Horse is not responsible.


Please allow up to 5 days for processing. In some cases, international and EU deliveries can take up to 6 weeks for your package to arrive. Deliveries to France can take up to 7-10 days from dispatch.


Each product is hand-cut and, as such, is subject to variations in weight, size and shape. Product appearance may vary from product images displayed on the website.


We reserve the right to refuse or cancel any order placed on www.terreandhorse.com. In the event of cancellation, the consumer will be notified by e-mail and will receive a full refund.


You can access the most recent version of the conditions of sale on this page at any time. We reserve the right, at our sole discretion, to modify, delete or replace any part of the conditions of sale by updating this site.



General terms and conditions of sale


ARTICLE 1 - Vendor designation


The present website www.terreandhorse.com is published by the limited liability company Terre & Horse with a capital of 2000 euros, whose registered office is located at 298 Chemin DE GUILHAMAT 31420 CASSAGNABERE-TOURNAS, registered with the RCS of Toulouse under number 914416235.


ARTICLE 2 - General provisions relating to these general terms and conditions of sale (hereinafter referred to as GTCS)


    Purpose: The GTCS apply exclusively to the online sale of products by Terre & Horse and its partners on the www.terreandhorse.com website (hereinafter referred to as the site) to which access is open.

    The General Terms and Conditions of Sale govern exclusively the online sale of products by Terre & Horse (hereinafter referred to as the seller) to buyers who are consumers (hereinafter referred to as consumers) and, together with the online order, constitute the contractual documents binding on the parties, to the exclusion of all other documents, prospectuses, catalogs or photographs of the products, which are for information purposes only. The GTCS are drawn up exclusively in France. The GTCS, as well as all contractual information mentioned on the site, are written in French.

    The GTCS are made directly available to consumers on the seller's website. By checking a box provided for this purpose, the customer acknowledges having read and accepted the GTCS before placing an order. Confirmation of the order implies acceptance by the purchaser of the GTCS in force on the day of the order, which are kept and reproduced by the seller.

    These terms and conditions were drawn up on 06 August 2020. The seller reserves the right to modify these terms and conditions at any time. In the event of modification of the GTCS, the applicable GTCS are those in force on the date of the order, a copy of which dated to that date may be given to the consumer on request.

    The nullity of a contractual clause does not entail the nullity of the GTCS. The temporary or permanent non-application of one or more clauses of the GTCS by the professional seller shall not constitute a waiver of the other clauses of the GTCS, which shall continue to be effective.


ARTICLE 3 - Products


    The products offered for sale in the catalog published on the site are each described in a description of their essential characteristics. The photographs illustrating the products do not constitute a contractual document. The photographs in the catalog are as accurate as possible, but cannot guarantee perfect similarity with the product offered, particularly with regard to colors and marbling.

    The site offers products for sale that can be used to carry out treatments, as well as decorative products. These products are intended for private individuals only. The information given on the products does not constitute medical information. Terre & Horse cannot be held responsible for damage caused by misuse of the products sold on its site, or by failure to observe the precautions for use.

    The products comply with current regulations relating to personal health and safety, fair trading and consumer protection at the time they were placed on the market. The products comply with the requirements of French law in force at the time they were placed on the market.

    Products sold on the site may not be resold without the written consent of Terre & Horse. Products sold on the site may not be reconditioned and resold without the written agreement of Terre & Horse.


ARTICLE 4 - Prices

    The sale prices are indicated, for each of the products listed in the electronic catalog, in euros including all taxes, excluding delivery and transport costs mentioned before validation of the order and invoiced in addition. The total amount due by the consumer is indicated on the order confirmation page. The selling price of the product is that in force on the day the order is placed. The selling price of products does not include shipping costs, which are invoiced in addition to the price. In the event of a price promotion, the professional seller undertakes to apply the promotional price to all orders placed during the promotional advertising period.

    The professional seller reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in force on the day of the order.

    Any additional charges for transport, delivery or postage (to which must be added any other charges borne by the seller), of which the customer may have become aware before placing the order, are set out on the order form.


ARTICLE 5 - Ordering


To place an order, the consumer, after having filled his/her virtual basket with the selected products and the desired quantities, clicks on the "Order" button and provides information concerning delivery and payment method. Before clicking on the "Confirm order" button, the customer can check the details of his order and its total price, and return to the previous pages to correct any errors or modify his order. Confirmation of the order implies acceptance of the GTCS and forms the contract. An e-mail acknowledging receipt of the order and payment is sent by the seller as soon as possible.

The data recorded by the site "terreandhorse.com" at the time of the validation of the order constitutes the proof of the whole of the transactions passed by the site "terreandhorse.com" and its customers. The data recorded by the payment system constitutes proof of financial transactions. The products remain the property of Terre & Horse until full payment has been received by Terre & Horse.

Any modification of the order by the customer after confirmation of the order is subject to acceptance by the seller. The seller reserves the right to make modifications to the product ordered in line with technical developments.

The seller reserves the right to refuse any order for legitimate reasons, and in particular if the quantities of products ordered are abnormally high for buyers who are consumers. The seller may also refuse or delay the processing of an order if it suspects fraud of any kind.


ARTICLE 6 - Offer


The online sales offers presented on the site are reserved for consumers residing in France.

The online sales offers presented on the site are valid for as long as the products appear in the electronic catalog and within the limits of available stocks, in the absence of any indication of a specific duration.

Acceptance of the offer by the consumer is validated, in accordance with the double-click procedure, by confirmation of the order.

Products are offered and delivered while stocks last. In the event of unavailability of the product ordered, the seller will immediately inform the purchaser and may offer a product of equivalent quality and price or, failing this, a voucher for the amount of the order to be used for any future order.  If the buyer does not agree, the seller will reimburse the sums paid within 5 working days. Apart from reimbursement of the price of the unavailable product, the seller is not liable for any cancellation indemnity, unless the non-performance of the contract is personally attributable to the seller.


ARTICLE 7 - Delivery


    Delivery refers to the transfer of physical possession of the goods to the consumer.

    Under normal conditions, the professional seller will process the order as quickly as possible from Monday to Friday, excluding public holidays and vacations, the dates of which will be clearly stipulated on the website "www.terreandhorse.com". Terre & Horse undertakes to dispatch orders within 48 working hours following validation of the order and subject to stock availability.

    The prepared order will be handed over to La Poste or its subsidiaries (Lettre suivie or Collissimo) for delivery within 3 to 4 days in Metropolitan France. Terre & Horse cannot be held responsible in the event of delivery being impossible due to the customer's fault. In order to facilitate delivery of the order by the carrier, the customer undertakes to make every effort to ensure that the parcel is delivered: name visible on the letterbox, transmission of the digicode and telephone number.

    In the event of damage to the parcel during transport, the customer must refuse the parcel to the letter carrier at the time of delivery.

    Delivery times are given as an indication only; if they exceed thirty days from the order date, the sales contract may be cancelled and the purchaser reimbursed.

    Products are delivered to the address indicated by the customer on the order form.

    If the product does not conform to the order, the consumer must send a complaint to the professional vendor in order to obtain a replacement product or, if necessary, cancellation of the sale.

    From the delivery date indicated on the order form, ownership of the product is transferred to the purchaser, except in cases where full payment of the price has not been received at the time of order.


ARTICLE 8 - Payment


All orders shipped within France are expressed in Euros, inclusive of all taxes, at the VAT rate in force in France. The price is payable in full once the order has been confirmed. Payment is made immediately upon ordering by credit card or Paypal. Payment is encrypted and secured by PRICE, Paypal or STRIPE.


ARTICLE 9 - Returns / Exchanges


The consumer has a right of return of seven days from receipt of his order to return any item that does not suit him and request an exchange or refund, with the exception of return costs which remain at his expense. The right of withdrawal can be exercised by contacting our customer service department directly from our website in the "Contact us" section. We will send you an acknowledgement of receipt of the cancellation on a durable medium (e.g. by e-mail). Returns must be made in their original condition and complete to enable them to be remarketed as new. Any product opened or damaged by the consumer will not be taken back. In the event of retraction, Terre & Horse will reimburse all payments received by re-crediting the consumer's credit card or Paypal account. Terre & Horse may defer reimbursement until receipt and verification of the products.


ARTICLE 10 - Security


The site is equipped with an online payment security system enabling the consumer to encrypt the transmission of his/her bank details via the payment security platform's electronic payment server. At no time will the customer's bank details pass through Terre & Horse's computer system.


ARTICLE 11 - Intellectual property


In general, the Brands and Logos appearing on this site, whether registered or not, are the exclusive property of Terre & Horse. All texts, comments, works, illustrations and images reproduced on the Terre & Horse site are reserved under copyright and intellectual property law for the entire world. As such, in accordance with the provisions of the Intellectual Property Code, only private use is permitted, subject to different or more restrictive provisions of the Intellectual Property Code. Any other use constitutes counterfeiting and is punishable under the Intellectual Property unless prior authorization of the site "terreandhorse.com" is strictly prohibited. All rights reserved.


ARTICLE 12 - Applicable law - Disputes


Terre & Horse shall not be held responsible for any damage resulting from improper use of its products.

The present contract and the GTCS governing it are subject to French law.
